Performve Limited (“Performve”) complies with the Personal Data (Privacy) Ordinance (‘Ordinance’) of Hong Kong, which came into force on 20th December 1996 and is under the supervision and monitoring by the Office of The Privacy Commissioner For Personal Data Hong Kong. Details about this Ordinance are provided in the official website of the Office of the Privacy Commission.
In addition, Performve also complies with Commissioner’s revised guidance made in August 2020 about collection, use, disclosure, sharing, and retention of face data (https://www.pcpd.org.hk//english/resources_centre/publications/files/GN_biometric_e.pdf)
Performve collects face data only for a lawful purpose directly related to the purpose of collecting the data which should be necessary and adequate but not excessive for such purpose. That means, collection should be lawful and fair while the data subject (employee) will be informed.
The only purpose of collecting face data is to record client employees’ clock-in and clock-out data (attendance) and where (location by GPS) they clock-in and out (for attendance also), which will be used for payroll calculation. All data are stored in our secured server.
Performve will not use the collected face data for any new purpose which is not or is unrelated to the original purpose when collecting the data, unless with the data subject’s (employee’s) express and voluntary written consent.
Performve takes all practicable steps to ensure that face data is accurate and is not kept longer than is necessary for the fulfilment of the purpose for which the data is used and will erase face data that is no longer required for the purpose for which the data is used, unless erasure is prohibited by law.
Performve shall take all practicable steps to protect the personal data against unauthorised or accidental access, processing, erasure, loss or use, and will not share with any third parties, unless with client’ and data subject’s (employee’s) express and voluntary written consent.”
